1. Agreement to these Terms
These Terms & Conditions (“Terms”) form an agreement between you and Ecloud Mart, the operator of the ZoraCook website and online store. By accessing the website, creating an account, submitting information, placing an order or otherwise using any part of the Services, you confirm that you have read and agree to these Terms and the policies referred to in them. If you do not agree, do not use the Services. Additional terms displayed for a product, promotion, payment method, delivery option or feature form part of these Terms to the extent applicable. If a mandatory law gives you rights that cannot be excluded or limited, those rights prevail over an inconsistent provision in these Terms.
2. Store operator and contact
ZoraCook is operated by Ecloud Mart from Ghaziabad, Uttar Pradesh, India. References to “ZoraCook”, “Ecloud Mart”, “we”, “us” and “our” mean the store operator, while “you” and “your” mean the person visiting or purchasing through the Services. Questions about these Terms, products or orders may be sent to support@zoracook.com. Contact details submitted to us must be accurate so that we can respond, verify an order, communicate changes and coordinate delivery or support.
3. Eligibility and authority
You may use the Services and place an order only if you are legally capable of entering the relevant transaction or are acting with the valid involvement and authorisation of a parent, guardian or authorised representative. If you place an order for an organisation or another person, you represent that you have authority to provide the relevant details and bind the purchaser to the transaction. Certain products may be unsuitable for children and must be purchased, stored and used only by responsible adults in accordance with product labels, instructions, warnings and applicable law. We may request reasonable verification or decline a transaction where eligibility, authority, safety, fraud or legal compliance is uncertain.
4. Accounts and account security
Account features, if available, are provided for convenience. You must provide accurate information, keep credentials confidential, restrict access to your device and notify us promptly of suspected unauthorised use. You are responsible for activity conducted through your account to the extent permitted by law. We may suspend access, require a password reset or take other reasonable steps where we suspect compromise, fraud, abuse or violation of these Terms. Account closure does not cancel completed transactions, payment obligations, valid claims, dispute records or provisions intended to survive termination.
5. Product information
We aim to present product names, descriptions, dimensions, weights, colours, photographs, compatibility information, features, included components and availability accurately. Display settings, lighting, manufacturing tolerances, packaging updates and supplier changes can produce minor differences between an image and the delivered product. Illustrative props and contextual items shown in photographs are not included unless the listing expressly states otherwise. You should read the complete product page, select the correct variant and review compatibility before ordering. If a material description error is identified, contact us with the order details and supporting information so that the matter can be assessed under applicable policy and law.
6. Product safety and responsible use
Kitchen tools, lighters, torches, portable stoves, fuel-related accessories and similar products can involve heat, flame, pressure, sharp surfaces, electricity or other hazards if mishandled. Products must be used only for their intended lawful purpose and strictly in accordance with the manufacturer’s label, manual, warnings, age guidance, ventilation requirements and maintenance instructions. Keep hazardous items away from children and unauthorised persons, do not use damaged or leaking products, and do not modify, misuse or combine products in a manner not approved by the manufacturer. We do not provide technical safety training through these Terms. If instructions are missing, unclear or appear inconsistent with the product, do not use the item and contact support or the manufacturer for appropriate guidance.
7. Pricing, taxes and corrections
Prices are displayed in the currency indicated on the store and may include or exclude taxes as described at checkout or required by law. Shipping charges, payment fees or other authorised amounts, if applicable, are shown before order submission. Prices and promotions may change without prior notice for future orders. We may correct typographical, technical or pricing errors and may cancel or seek confirmation of an order affected by an obvious error, even after an automated acknowledgement, subject to applicable consumer law. If an affected paid order is cancelled, the amount received for that order will be returned through an appropriate method. A temporary website display, abandoned cart, screenshot or cached page does not guarantee a price after it has changed.
8. Promotions, discounts and coupons
Promotions may have eligibility requirements, validity periods, minimum-order values, product exclusions, usage limits and other conditions stated with the offer. Unless expressly permitted, discounts cannot be combined, exchanged for cash, transferred, applied retrospectively or used through multiple accounts to evade limits. We may refuse or reverse a promotional benefit obtained through manipulation, automated abuse, duplicate identities, misleading information or a clear technical error. Ending or modifying a promotion does not affect an order already accepted at a valid promotional price, except where cancellation or correction is permitted by law.
9. Order submission and contract formation
Placing an order is an offer to purchase the selected products. An on-screen message, payment authorisation or automated email confirming receipt does not necessarily mean that we have accepted the order. Acceptance generally occurs when the order is confirmed for fulfilment or dispatched, depending on the transaction flow. We may verify inventory, payment, address, quantity, risk indicators and legal or delivery restrictions before acceptance. We may refuse or cancel an order for unavailability, suspected fraud, payment failure, inaccurate information, restricted delivery, excessive quantity, safety concern, listing error or another legitimate reason. Where a cancelled order has been paid, an appropriate refund will be initiated, subject to banking and provider processing times.
10. Payments
Available payment methods are displayed at checkout and may be provided by independent payment processors, banks, card networks or UPI participants. You authorise the applicable provider to process the amount shown and confirm that you are entitled to use the chosen payment method. Payment can be subject to provider authentication, limits, fraud checks and separate terms. We are not responsible for a bank’s decline, temporary hold, duplicate-looking pending entry or processing delay outside our reasonable control, but we will review store-side records when you provide relevant transaction and order information. Never send complete card details, passwords, PINs or one-time passwords to customer support.
11. Shipping, delivery and risk
Shipping options, charges and estimated timelines are displayed where available. Estimates are provided in good faith but are not guarantees because delivery can be affected by address accuracy, serviceability, courier capacity, weather, public restrictions, holidays, transportation disruptions, verification, force-majeure events and circumstances outside our reasonable control. You must provide a complete serviceable address and reachable contact information, and arrange for an authorised person to receive the parcel. Failed delivery caused by inaccurate details, repeated unavailability, refusal or other customer-side circumstances may result in return-to-origin handling and additional consequences permitted by the disclosed policy and law. Ownership and risk are allocated according to applicable law and the nature of the transaction; nothing here removes liability that cannot legally be excluded.
12. Inspection on delivery
Inspect the external parcel and delivered items promptly. If an item is missing, incorrect, visibly damaged, materially defective or inconsistent with the accepted order, preserve the packaging, labels, invoice and relevant evidence and contact support within the period stated in the applicable return or refund policy. Do not continue using a product that appears unsafe or damaged. We may request reasonable photographs, video, serial or batch information, courier documentation or return of the item so that the claim can be evaluated. Evidence requirements will be applied reasonably and do not remove mandatory consumer remedies.
13. Cancellations, returns, replacements and refunds
Eligibility for cancellation, return, replacement or refund depends on the order status, product condition, product category, stated store policy and applicable law. Certain opened, used, damaged, safety-sensitive, consumable, customised or hygiene-related items may be ineligible for change-of-mind return where the law permits that restriction, while defective, incorrect or legally non-conforming goods remain subject to applicable rights. Refunds are ordinarily sent to the original payment method or another lawful method after approval and required processing. Bank and payment-provider timelines are outside our direct control. Review the store’s published refund policy and contact support before returning an item; unauthorised returns may be delayed or rejected where permitted.
14. Customer communications
We may contact you using details supplied with an account, order or request for transactional purposes such as payment status, verification, dispatch, delivery, returns, refunds, safety notices, account security and support. Promotional communications, where used, are subject to applicable permissions and opt-out methods. You must not impersonate another person, submit abusive or unlawful material, send malware, attempt social engineering or use support channels to obtain confidential system or customer information. We may retain relevant communications for service, quality, security, dispute and legal purposes as described in the Privacy Policy.
15. Acceptable use of the website
You must not use the Services to violate law or another person’s rights; interfere with security or operation; introduce malicious code; scrape, crawl, copy or extract data through unauthorised automated means; bypass access controls; test vulnerabilities without written permission; misrepresent identity or affiliation; submit fraudulent orders, reviews, chargebacks or claims; harass staff or users; reproduce protected material beyond lawful limits; or use the store to facilitate unlawful, unsafe or deceptive conduct. Reasonable use of ordinary search engines and browser functions is not prohibited by this clause. We may investigate suspected misuse and restrict access or preserve evidence where reasonably necessary.
16. Intellectual property
The ZoraCook name, logos, visual identity, website design, text, graphics, product photography, videos, compilations and other store materials are owned by or licensed to Ecloud Mart or relevant rights holders and are protected by applicable intellectual-property laws. We grant you a limited, revocable, non-exclusive and non-transferable permission to access the Services for personal shopping and lawful evaluation. No ownership right is transferred. You may not reproduce, distribute, sell, create misleading derivatives, remove notices or commercially exploit protected materials without written permission, except to the extent expressly allowed by law.
17. Reviews, feedback and user submissions
If you submit a review, suggestion, photograph, question or other content, you confirm that you have the right to submit it and that it is accurate to your genuine experience, relevant, lawful and free from confidential information or infringement. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, moderate and display the submission for operating and promoting the Services, subject to applicable privacy law. We may remove content that is unlawful, abusive, misleading, irrelevant, promotional spam or technically harmful. We do not promise to publish every submission and do not claim that user opinions represent our views.
18. Third-party services and links
The Services rely on or may link to third parties such as Shopify, payment providers, couriers, maps, social networks and embedded tools. A link does not mean that we control or endorse every aspect of the external service. Third parties may apply separate terms, privacy notices, availability rules and charges. To the extent permitted by law, we are not responsible for an external service’s independent content, systems, acts or omissions. Problems directly relating to an order placed with us should nevertheless be reported to our support team so that we can address the portion within our responsibility.
19. Availability and changes to the Services
We may update, maintain, suspend or discontinue features; correct errors; change product ranges; and modify the appearance or operation of the website. Interruptions can occur because of maintenance, platform incidents, network failures, security events or circumstances outside our control. We do not guarantee that every feature will always be uninterrupted, error-free or compatible with every browser and device. Changes will not remove rights already attached to an accepted order except as permitted by these Terms and applicable law.
20. Disclaimer of warranties
To the fullest extent permitted by law, the website and general informational content are provided on an “as available” basis without warranties beyond those expressly stated or legally implied. We do not promise that general content will meet every individual requirement or that the website will be free of all errors or interruptions. Product warranties, guarantees and consumer remedies apply as stated in the product materials, store policy and mandatory law. Nothing in these Terms excludes statutory guarantees or other protections that cannot lawfully be excluded.
21. Limitation of liability
To the fullest extent permitted by applicable law, neither Ecloud Mart nor its personnel will be liable for indirect, incidental, special or consequential loss arising solely from use of or inability to use the website where such loss was not reasonably foreseeable and was not caused by a breach of a non-excludable duty. Any limitation is subject to mandatory consumer protections and does not exclude liability for fraud, wilful misconduct, personal injury caused by negligence where exclusion is prohibited, defective products where statutory liability applies, or any other matter that cannot lawfully be limited. You remain responsible for following product instructions, warnings and lawful-use requirements.
22. Indemnity for unlawful misuse
To the extent permitted by law, you agree to be responsible for losses, claims and reasonable costs directly resulting from your intentional unlawful misuse of the Services, fraudulent conduct, infringement of another person’s rights or material breach of these Terms. This clause does not require a consumer to compensate us for loss caused by our own breach, negligence or conduct for which responsibility cannot legally be transferred, and it will not be interpreted to remove a mandatory defence or remedy.
23. Force majeure
We are not responsible for delay or failure to the extent caused by events beyond reasonable control, such as natural disasters, severe weather, fire, epidemic, war, civil disturbance, governmental action, transport disruption, labour interruption, utility or telecommunications failure, cyber incident affecting external infrastructure, platform outage or courier network disruption. We will take reasonable steps appropriate to the circumstances, including communicating material order impacts and providing remedies required by law. Payment obligations for goods not supplied remain subject to applicable refund rights.
24. Suspension and termination
We may suspend or terminate access to account or website features where reasonably necessary to address fraud, security risk, unlawful conduct, repeated abusive behaviour, unauthorised automation or material violation of these Terms. Where appropriate, we may provide notice or an opportunity to clarify the issue. Termination does not affect an accepted order, accrued payment, valid refund, intellectual-property right, dispute record or provision that by its nature should continue. You may stop using the Services at any time and may request account closure subject to lawful record retention.
25. Governing law and dispute resolution
These Terms are governed by the laws of India. Subject to any mandatory consumer forum, statutory jurisdiction, online dispute mechanism or other right that cannot be restricted, courts of competent jurisdiction in Uttar Pradesh will have jurisdiction over disputes connected with the Services. Before commencing formal proceedings, you are encouraged to contact support@zoracook.com with the order number, relevant facts and requested resolution so that we can attempt a practical response. This clause does not prevent either party from seeking urgent relief where legally available.
26. Severability, waiver and assignment
If a provision of these Terms is found invalid or unenforceable, it will be limited or removed only to the minimum extent required, and the remaining provisions will continue. A delay in enforcing a right is not a permanent waiver. You may not assign rights or obligations arising from an order without consent where assignment would materially affect the transaction, except where law provides otherwise. We may transfer operation of the business or an agreement as part of a genuine reorganisation, merger or sale, subject to applicable notice, privacy and consumer requirements.
27. Entire agreement and policy relationship
These Terms, the Privacy Policy, any applicable refund or shipping policy, the accepted order details and product-specific conditions form the agreement relating to your use and purchase. Headings are for convenience and do not narrow the text. If a product-specific term conflicts with a general term, the more specific term ordinarily governs that product, while mandatory law governs over both. Informal statements do not modify an accepted order unless confirmed by an authorised communication or required by law.
28. Changes to these Terms
We may revise these Terms for future use to reflect changes in law, products, store operations, platform features or risk controls. The current version will be posted with an updated date. Changes generally apply from publication and do not retroactively remove rights under an already accepted order. If a material change requires specific notice or consent, we will take the steps required by applicable law. Review these Terms before placing each order.
